There is probably no one in America that doesn't know what a DUI is. There are public service announcements all over the place, there are street signs all over the place, and any time any kind of celebrity gets a DUI it's all over the news. But most people believe they have to have a breath test reading of.08 or higher to get a DUI, and that just isn't true.
I know most people think this because I am a DUI attorney, and nearly every one of my potential clients that comes in with a breath test reading under.08 is under the impression that because they took the test and were under that they were free to go. It's at that point that I tell them there are actually three ways to be found guilty of DUI, and only one of them involves the breath test.
The other two methods of DUI actually make sense when you think about what the title of the law is and what the law is meant to punish. If you take a breath test and blow over.08 there is a presumption that you were too drunk to drive, and really little else needs to be proven. But at the heart of a DUI charge is that you actually were too impaired to drive. These are the other two prongs of the DUI law.
Essentially, the state can try to prove that you were too drunk to drive because you'd been drinking and you were operating a vehicle in a poor manner. Or, they can show that you performed poorly on field sobriety tests or showed other signs of being intoxicated. In the end, the true question is could you properly operate a vehicle or where you impaired to such an extent that driving was unsafe?
