Can the court or a car company seize a different car after reposession?
I know someone who had a New Car repossed and they had to go to court. That person bought a Used Car for cash. The New Car dealership repossed the Used Car that was paid for. Is that legal?
Is it possible that person signed something stating the new dealer can seize or put a lean on any property owned by the buyer? Can this person sue the new dealer if this person never signed such document in the bill of sale?
It depends on state law and the specifics of the original contract.
When the original car was repossessed, it was probably auctioned off for much less than the remaining balance on the loan. The person was then liable for the difference. The bank took the person to court, sued them, and won a judgment for that outstanding balance.
In some states the bank can put a lien on certain personal property such as cars, real estate, etc to secure the judgment. I didn't know they could actually repossess a different car, but i guess it might be possible under some state's laws. Some states also allow the bank to request wage garnishment if the person doesn't pay the judgment.
